- A description of where the allegedly infringing material is located on the Website, with sufficient detail to allow us to locate it.

- Your address, telephone number, and email address.

- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on behalf of the owner.

REPEAT INFRINGER POLICY. In accordance with applicable law, we may terminate the accounts of users who repeatedly infringe the intellectual property rights of others. We may also limit access to the Website or Services for any user who infringes any intellectual property rights, whether or not the infringement is repeated.

USER CONTRIBUTIONS. If you submit or post comments, testimonials, photos, videos, or other materials (“User Contributions”) on or through the Website or our social media channels, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, display, and distribute such User Contributions in any media, for marketing, promotional, and informational purposes, unless you explicitly state in writing that we do not have such permission.

FEES. Any fees for travel services, planning fees, consultation fees, or other services are displayed on the Website, in proposals, or communicated directly to you. We reserve the right to change fees at any time, provided that changes will not affect fees already agreed to in a confirmed written service agreement or booking confirmation.

REFUND POLICY. Refunds for planning fees, service fees, or other charges are governed by the specific terms communicated in your proposal, agreement, or booking documents. Some fees may be non-refundable once services are rendered or once travel arrangements are confirmed with suppliers. Supplier-specific refund, cancellation, and change policies may also apply to your bookings. We will provide or reference applicable terms at the time of booking.

PAYMENT POLICY. You agree that all payment instruments, credit cards, and related information (including billing address) used in connection with any paid Services are valid, correct, and that you are authorized to use such payment instrument. You authorize the Company and/or its payment processors (including Travefy or other third-party tools) to bill your payment instrument for the agreed fees in accordance with any payment plan or booking terms.

RECURRING SUBSCRIPTIONS. If at any time we offer recurring subscription services (such as memberships or ongoing programs), the terms for such subscriptions, including billing and cancellation policies, will be provided at the point of purchase. If you enroll in a subscription, you authorize automatic recurring charges until you cancel in accordance with the provided terms.

LATE PAYMENTS. If payments due to the Company are not made on time, we reserve the right to charge interest on all past-due amounts at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater, and to suspend or terminate Services until payment is received.

CHARGEBACKS. You agree to contact us to request a refund or dispute a charge before initiating a chargeback with your financial institution. If you initiate a chargeback without first attempting to resolve the issue with us, we may consider your access to future services, products, and bookings with the Company forfeited. We may provide proof of your agreement to these Terms and any service records to the financial institution.

You agree to indemnify, defend, and hold harmless Hebert Expeditions LLC, its owners, employees, agents, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website or Services, your User Content, or your violation of these Terms.

LIMITATION ON LIABILITY. To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Website or Services, even if foreseeable. Any direct liability shall be limited to the amount you paid to the Company for Services directly related to the claim, if any.
